The following Terms of Use (‘Terms’) govern the use of NQBP Engage (“the site”). The software platform is owned by Social Pinpoint Pty Ltd (ACN 164 471 425) and operated by us, North Queensland Bulk Ports Corporation (ACN 136 880 218) (NQBP).
By registering for, accessing and/or using this site, you acknowledge that you accept and agree to be bound by the Terms and the Privacy Policy and Moderation Policy. These Terms apply to all visitors and users of this site. If you disagree with any of the Terms, you cannot use this site.
If you are under 18 years old, please ensure that your parent or guardian accepts these Terms (including the Privacy Policy and Moderation Policy).
What are the conditions for use of the site?
When you use the site, you agree not to breach any applicable law or regulation.
If you create a user account with us, you must provide us with accurate information. Failure to provide accurate information or attempting to impersonate any person or entity violates the Terms, which may result in immediate termination of your account. You are responsible for protecting your own password you use for this site and for any activities done under that password. Unauthorised use of your password or account must be promptly reported to us. In some cases, we or our agents may require access to your user accounts to respond to technical issues.
All information, data, images and other materials posted on the site are the sole responsibility of the person from whom the content originated. Whilst we will take every care to review all material, we are not responsible for the content on the site that has been provided by the users of the site. Content posted by users is subject to the rules of our Moderation Policy. Contributions to the site may be edited, removed or not published if we consider it inappropriate in our absolute discretion. Contributors should also be aware that posts may remain online indefinitely.
What do we require from users?
When you use the site, you understand and agree that you must not:
- advertise or offer to sell or buy any goods and/or services;
- transmit content that contains software viruses or programs designed to change or destroy the functionality of any computer software or hardware;
- collect or store personal data about other users of the site;
- impersonate any person or entity, including without limitation to an NQBP representative;
- interrupt or interfere with the site or servers or networks connected to the site; or
- you cannot attempt to gain unauthorised access to the site or other use accounts.
Can your account be suspended or terminated?
We may discontinue the site, close accounts of any user and change eligibility requirements or these terms at any time.
We may terminate or suspend the access of a user to our site and/or account immediately, without prior notice, including without limitation if a user breaches the Terms. We may immediately deactivate or delete your account and all the related files and information in your account. After your account has been terminated, the content you have posted may also remain indefinitely on the site.

What content do we own?
The site contains the copyrighted material, trademarks, patents, trade secrets and other proprietary information (“Intellectual Property”) of NQBP and its suppliers and licensors. NQBP either owns and retains all proprietary rights in the Intellectual Property or holds a licence to use the Intellectual Property. Users must not copy, alter, transmit, sell, distribute any of the intellectual property on this site.
Any original content that you submit or post on our site may form part of the Intellectual Property owned by us, and therefore may be reproduced by us, however where possible such material may be made available to share (with the end user acknowledging contributions and copyright material) under the Creative Commons Attribution-ShareAlike 4.0 Australian License.
Disclaimer and Warranties
NQBP its subsidiaries, related parties, officers, agents, licensors and other partners are not responsible for any loss, liability, claim, or demand, including legal fees, made or incurred by any person howsoever arising from the use of or access to this site. Users agree that use of the site is at the user’s own risk. We make no warranty that the site will meet your requirements or be uninterrupted or error-free. Any material that the user downloads through the site including via links to third-party sites, is done at their own risk and users are responsible for any damage to their computer system or loss of data.
Users agree that NQBP has made no representations or warranties in relation to the proposed Bowen Wharf redevelopment project, including whether it will proceed in the manner outlined on the site or at all. NQBP makes no statements, representations or warranties about the accuracy or completeness of, and users should not rely on, any information contained in this site.
These Terms shall be governed in accordance with the laws of Queensland, Australia.
What happens if these Terms change?
We reserve the right, at our sole discretion, to modify or replace these Terms at any time without notice. The most recent version of the Terms can be seen on this page. By continuing to access or use our site after those revisions become effective, you agree to and will comply with the revised terms. If you do not agree to the revised terms, please discontinue using our site.
